To be eligible to apply, an entity must meet all the following criteria:
- Have received an award in the 2020 Live Venue Relief Program;
- Be categorically excluded and/or ineligible to apply for the federal Shuttered Venue Operators Grant (SVOG) program;
- Resumed operation in 2021 and agree to continue operation for a minimum of two years;
- Not have received an award that can be used to cover the same operating expenses from any other source; and
- Certify that venue has been unable to generate sufficient revenue to satisfy its actual 2021 operating expenses as of the submission date of this application.
- Are there preset “categorical exclusions” for LVAP?

Yes, the federal Shuttered Venue Operators Grant (SVOG) Program has predetermined criteria that determine categorical exclusion from that program. Several of those criteria will be used to determine qualification for applicants in the LVAP.
Those categories include the following, with an opportunity for an applicant to select “Other” and explain why they may have been categorically excluded from the SVOG outside of these listed criteria:
- Your business is:
- Operated by a publicly traded corporation;
- Majority owned and controlled by a publicly traded corporation;
- Owns or operates venues, theatres, museums or talent agencies in more than one country, own or operate venues, theatres, museums or talent agencies in more than ten states, and had more than 500 employees as of February 29, 2020; or
- Affiliated with five other venues that have already received SVOG awards.

You need to consult your accountant and /or legal counsel and base your answer on the federal definitions, which can be found at https://www.sba.gov/funding-programs/loans/covid-19-relief-options/shuttered-venue-operators-grant. The application for this program also contains a pick list from which to choose the categorical exclusion that applies to you, with an “other” option to provide an alternative explanation for your categorical exclusion that might apply.
- How will awards be calculated?

LVAP awardees will receive a pro rata percentage of their actual January 1, 2021, to April 30, 2021, operating expenses, up to 75% of those expenses or $750,000 – whichever is lower.
- What will I have to submit to show 2021 operating expenses?

LVAP applicants will have to submit a monthly expense statement for each month from January 1 through April 30, 2021, in the form that your entity normally generates and keeps for its business records of expenses.
